Citing the viability of sports quota on constitutional grounds Hyderabad HC calls for the dissolution of the sports quota for getting admission in educational institutes.
Reasons given by the high court
- The quota itself is illegal because it does not have any sanction from the constitution.
- It is basically a backdoor entry for non-meritorious students.
- "Insignificant" games were listed under the sports quota by the Andhra Pradesh government.
Bench of justices Anis and Ramasubramanian said, "It is sad to note that except video games, all other games that one could conceive of have been brought within the sports quota to enable persons who cannot excel in studies to gain admission into medical courses through the backdoor."
The policy is also harming sports as justice said "Ultimately, persons who gain admission into medical courses under this quota lose their flavor for sports."
They were "inventions made for the purpose of diluting the constitutional guarantees granted to SCs, STs and BCs", as the bench said
On the basis of new orders a student who was denied admission in MBBS College in NTR University of Health Sciences filed a petition but it was denied by the court.
